What is Spousal support? How is spousal support defined in California family law? The Orange County Spousal Support Attorney explains that the terms “spousal support” and “alimony” are used interchangeably. These terms are used to describe payments that are paid by one spouse to the other. A judge will determine the amount of spousal support to be paid. Spousal support can be ordered paid for half the time of the marriage in a short marriage or in cases of a long marriage of ten years or more until the spouse dies, remarries or begins cohabitating. The reason spousal support orders are made, is to ensure a party has adequate support to live on. Spousal Support is to maintain a standard of living comparable to the one lived, throughout the marriage.

Spousal Support is to assist parties financially until they are able to seek employment, training or to find resources so the supported party can provide for themselves now that they are no longer sharing financial responsibilities with the other individual. Furthermore, it is common for one of the parties to either have worked at home caring for the children, or perhaps one of the parties has lost their job.

The family law judge will take various factors into consideration when determining the amount of spousal support to order. The judge will consider the California Family Code section 4320, factors of age, health, need, marital standard of living, any documented conviction of domestic violence, if one party paid for the other spouse to obtain higher education, the tax consequences and the balance of the hardships. The court must then use his or her discretion in making an award for spousal support. Moreover, it is important to understand that if in the future any of your circumstances change regarding wages, it may be possible to request a modification of the order at a later date.
