The time has come and now you find yourself asking, “ How do I prepare for a divorce in Orange County ? “ You are confused and you do not know where to turn for advise. Your friends and family mean well by trying to render legal advise, but let’s face it, in most instances they do not know the law and my be giving you incorrect advise.

I recommend you do the smart thing and find a family law attorney in your area and request a free consultation in order to protect your rights.  The Attorney will or should ask if all other remedies to save the marriage have been exhausted. For instance, have you and your spouse considered professional counseling? Divorce should always be your last resort.  Let’s face it life is like a rollercoaster, we have our ups and downs. Marriage is always a work in progress, couples need to always make an effort to feed the relationship. At times for the sake of the marriage and children the parents must compromise.

Once you have made up your mind and counseling did not work, dissolution may be the answer after weighing the pros and cons. Some couples separate for a short term in order to be alone and think things through. Others feel that they have given the marriage enough time to work and feel that keeping their loved ones in limbo is not fair; therefore, they proceed with the divorce.

Now if there are children in your marriage, this can be very difficult for some parents to handle. Many times the children do not understand the parent’s decision to divorce. Some client’s going through a divorce will need to get professional help for their children in order to help them cope with divorce.

Their world has just been turned upside down and they need to learn to cope with the facts. In some cases they need therapy to help them heal the pain. They need to be reassured that both parents still love them and that both parents will continue to be part of their lives. Be compassionate and sincere, but never lie to them. There is a plethora of online sites and online videos that give good advise on how to help children deal with divorce.  I highly recommend you search the web in order to edify yourself on how to speak with your children if you feel you do not know how to approach your children.

Next, can you afford to financially support yourself or are you dependent on your spouse? The last thing you want to do is find yourself homeless. Do you have a support network that knows of your decision and is willing to assist you? Understand that all actions have consequences. Ending a marriage is tough and you will be starting a new life and in most cases finances may be an issue regardless if you were the main breadwinner or not. If finances are an issue and you are clueless as to how to proceed, I recommend you consult with a family attorney. They will counsel you as to what you legally can do with community accounts; moreover, they will present options you may have not thought of. Just understand that contested divorces can be pricy; therefore, do your homework before you decide to jump ship.

As an Orange County divorce attorney I help clients with simple divorces to complex divorces. The complex divorce cases must navigate through stocks, child custody, property division, business division/buyouts, alimony, 401ks and much more.

Now if you decide that “pro per” (representing yourself) is not for you, then you will need to consider retaining a family law lawyer to help safeguard your rights. Keep in mind that divorce & family law can be a challenging area of the law. At times I find myself instructing other attorneys and vise versa on how to proceed in certain cases. Sometimes the law is not black and white and attorneys interpret the law to the best of their knowledge and hope that the judge also sees it their way. Therefore, to be absolutely sure you are hiring an expert in the field of family law & divorce, I recommend you obtain a consultation with a certified family law specialist. They are considered the cream of the crop when it comes to family law cases. Many offer payment plans and free initial consultations.
